Terms of Service

These Terms of Service ("Terms") govern your use of where-to-dive.com (the "Site"), operated by Secure Cyber USA LLC, a Florida limited liability company ("we," "us," "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. What the Site Is (and Isn't)

where-to-dive.com is a directory and comparison service for scuba diving charters, liveaboards, and related trips. We index publicly available information about dive operators — including trip descriptions, schedules, prices, and dive sites — and link you to the operator's own website or booking platform.

We are not a travel agency, booking agent, or tour operator. We do not:

When you click through to book a trip, your transaction is solely between you and the operator (or their booking platform). The operator's own terms, cancellation policies, waivers, and safety requirements govern that transaction.

2. Accuracy of Listings

Listed prices, schedules, availability, inclusions, and other details were observed on the operator's website or a booking platform at the time we indexed them. They may be out of date, incomplete, or inaccurate, and operators may change them at any time without notice to us. Where we display an "as of" date, it reflects when the information was observed, not a guarantee of current accuracy.

Always verify prices, availability, certification requirements, and safety details directly with the operator before paying.

3. Referral Links and Compensation Disclosure

Some links on the Site are referral or affiliate links. If you book a trip after clicking one of these links, we may earn a commission from the operator or booking platform at no additional cost to you. This compensation does not affect the price you pay, and it does not influence which operators appear in our index.

4. Diving Is a Hazardous Activity — Assumption of Risk

Scuba diving, freediving, snorkeling, and related water activities involve inherent and significant risks, including serious injury and death. We do not vet, inspect, audit, or certify the operators, vessels, equipment, guides, or instructors listed on the Site, and a listing on the Site is not an endorsement or representation of safety or competence.

5. Intellectual Property

The Site's design, original text, compilation, and arrangement of listings are owned by us. Operator names, trip descriptions, photographs, and trademarks belong to their respective owners and are displayed for identification and informational purposes.

If you believe content on the Site infringes your copyright, contact us at rameenhash@gmail.com with: (a) identification of the work, (b) the URL of the allegedly infringing material, (c) your contact information, (d) a statement of good-faith belief that the use is unauthorized, and (e) a statement, under penalty of perjury, that you are the owner or authorized to act for the owner. We will review and respond promptly, including removal where appropriate.

7. Accounts

If you create an account, you are responsible for safeguarding your credentials and for activity under your account. You must provide accurate information and be at least 18 years old to create an account.

8. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT LISTINGS ARE ACCURATE, COMPLETE, OR CURRENT, OR THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, DEATH, PROPERTY DAMAGE, LOST PROFITS, OR LOST DATA, ARISING FROM (A) YOUR USE OF THE SITE, (B) ANY TRIP, ACTIVITY, OR TRANSACTION WITH AN OPERATOR FOUND THROUGH THE SITE, OR (C) INACCURATE OR OUTDATED LISTING INFORMATION. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your dealings with any operator.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Palm Beach County, Florida, and you consent to their jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date reflects the current version. Material changes will be posted on the Site, and continued use after changes take effect constitutes acceptance.
